Violators of military registration rules have begun to be restricted from driving cars. In the future, the CCC's chances of obtaining punishment will be even greater.
Ukraine has recorded the first case of a driver being restricted from driving because he violated military registration rules, the Express newspaper reports, citing the Opendatabot portal.
According to the source, this case was recorded in the Rivne region. "The Kuznetsov City Court (the current name of the city is Varash - Author) ruled to impose a temporary restriction on the citizen's right to drive vehicles during mobilization - for the period until the fulfillment or withdrawal of the CCC's requirement on the fulfillment of duty (duties) by a conscript (reservist) No. 6997 dated October 28, 2024. The court's decision is subject to immediate execution," the court decision states.
As Opendatabot specifies, at least 41 court cases related to the restriction of the right to drive a car due to violation of military registration rules have currently been registered in Ukraine, according to the data of the search engine for the court registry. However, in most cases, the courts return the cases, mostly due to problems in the processing of claims (in particular, with non-payment of the CCC court fee).
As lawyer Valentyna Slobodyanyuk stated in a comment to Opendatabot, since the relevant innovations to the legislation of Ukraine on mobilization came into force in mid-2024, the CCC could simply not pledge finances to pay the court fee. “It is worth understanding that this situation is temporary — so already in 2025 such an expense item should appear in the CCC budgets, respectively, and the chances (of military enlistment offices — Author) of success in the courts will increase,” she concluded.
Deprivation of driving licenses for traffic offenders: what is known
According to the new version of the law on mobilization in Ukraine, which came into effect on May 18, 2024, evading military service may result in the loss of a driver's license.
As stated in the text of the document, if a Ukrainian citizen subject to military service does not update his data in the CCC and SP within the established deadlines or does not appear on the summons, the institution contacts the police with a demand to detain the violator. If the police fail to detain him, they send him a demand to fulfill his duties within five days.
If there is no response within 10 calendar days, the CCC will go to court, which may restrict the right to drive during mobilization.
However, the court cannot restrict the right to drive a vehicle if:
- the restriction deprives the person of their main source of income;
- the person has a disability;
- the person is dependent on a person/persons with disabilities of groups I, II or a child with disabilities.
